Per la Corte di assise d’appello di Torino è omicidio colposo quello commesso il 7 giugno 2019 da Franco Iachi Bonvin, condannato in via definitiva a un anno e otto mesi senza reclusione. La pena, in parziale riforma della sentenza pronunciata il 30 maggio 2024 dal Tribunale di Ivrea che lo aveva condannato in primo grado a cinque anni di reclusione, ha riconosciuto le attenuanti, con la riduzione per la scelta del rito e con il beneficio della sospensione condizionale della pena. I difensori avevano rinunciato al ricorso in Cassazione, chiudendo l’iter giudiziario. Trascorsi i termini, è arrivata quindi la sentenza della Cassazione. Come riportato nella sentenza dei giudici di Cassazione, intorno alle 2.30 di notte, mentre Marcellino Franco Iachi Bonvin “dormiva al secondo piano dell’immobile dove abitava, a Pavone Canavese, sentiva la sirena dell’allarme antintrusione del bar Fast-Furius (di sua proprietà, ma gestito da altri) al piano terra dello stesso immobile e, affacciatosi dal balcone, aveva notato tre individui a volto coperto che stavano caricando su un furgone (risultato poi rubato) l’apparecchiatura elettronica cambiamonete prelevata dal bar (che risultò contenere la somma di 3.000 euro)”. Il tabaccaio sparò diverse volte con un revolver calibro 357 legalmente detenuto, colpendo e uccidendo con uno dei proiettili il 24enne Ion Stavila. The tobacconist fired several times with a .357 revolver legally held, hitting and killing 24-year-old Ion Stavila with one of the bullets. According to the judges, the situation was comparable “to the hypothetical case of self-defense”: Marcellino Franco Iachi Bonvin, by firing the shot that killed Ion Stavila, “had inadvertently overstepped the limits of self-defense.” For this reason, the appellate judges modified the charge from voluntary manslaughter to manslaughter. L'Unità: Cospito, la tortura deve continuare: Nordio conferma il 41bis, “carcere duro” per altri due anni La decisione del ministro Carlo Nordio era più che scontata, in linea con il trattamento riservato al detenuto pericolo pubblico numero uno al quale di recente era stato negato l’acquisto di quattro libri e di un Cd. Nordio ha prorogato di altri due anni il regime del 41 bis per l’anarchico Alfredo Cospito confermando la scelta che nel 2022 aveva fatto la ministra Marta Cartabia che vantava una fama, forse immeritata, di garantista. La decisione di Nordio sarà impugnata con ricorso al Tribunale di Sorveglianza di Roma, unica autorità chiama a decidere sull’applicazione del regime di carcere duro in tutta Italia. Un ricorso che ha scarse possibilità (eufemismo) di successo considerando quanto accaduto in passato nonostante la direzione nazionale antimafia e antiterrorismo, non certo una congrega di anarchici, si fosse detta favorevole al regime di alta sicurezza meno afflittivo. Il Tribunale di Sorveglianza e la Cassazione non avevano voluto sentire ragioni. Cospito, detenuto nel carcere di Sassari Bancali, paga il lunghissimo sciopero della fame con il quale nel 2023 aveva protestato contro il 41 bis, non tanto per sé quanto per gli oltre 700 reclusi al quale viene applicato. Il lungo digiuno aveva riscosso non poche simpatie anche al di là dell’area anarchica e questo aveva messo in imbarazzo i poteri costituiti dalla politica alla magistratura. Insomma, era stato considerato una sorta di sciopero della fame “a scopo di terrorismo e di eversione dell’ordine costituzionale”. Per cui lo Stato in tutte le sue articolazioni aveva deciso che Cospito l’avrebbe pagata duramente fino in fondo. Siamo da tempo oltre lo spirito e la lettera del 41 bis varato solo per evitare contatti dei detenuti con le organizzazioni di appartenenza. Invece siamo arrivati a restrizioni e vessazioni assurde fino alla tortura. In pratica terrorismo di Stato.
