Il recente divieto imposto dalla Casa Bianca a emittenti e quotidiani critici nei confronti dell’amministrazione Trump deve essere temporaneamente revocato. Lo ha stabilito il giudice federale Timothy Kelly, secondo cui Donald Trump deve ripristinare l’accesso di Cnn, Msnbc e Politico alla sede del governo statunitense, dopo che ai giornalisti delle testate era stato revocato l’accesso.
Nella sentenza, Kelly ha stabilito che la revoca dei pass stampa dei giornalisti è avvenuta in assenza di un “giusto processo costituzionalmente adeguato”. Secondo il giudice, dunque, il provvedimento potrebbe risultare incostituzionale.

Sempre il giudice federale, stando a quanto riferisce la Cnn, ha fatto notare che le argomentazioni del governo addotte per giustificare il provvedimento “offrono scarso sostegno alla presunta esigenza di sicurezza nazionale”. Per questo Kelly ha emesso un ordine restrittivo che sospende il divieto per 14 giorni, concedendo così ulteriore tempo per esaminare il caso.
Il provvedimento arriva nel contesto dello scontro tra l’amministrazione Trump e alcuni importanti organi di informazione statunitensi. Negli ultimi mesi, il presidente degli Stati Uniti ha più volte attaccato sui social diverse testate, sostenendo, tra le altre cose, che Cnn, Msnbc e Politico “non dovrebbero poter scrivere o riferire costantemente INVENZIONI e BUGIE”.
L’amministrazione aveva giustificato il divieto anche sulla base di presunte ragioni di sicurezza nazionale. Secondo quanto riportato dalla Cnn, tuttavia, il giudice Kelly ha ritenuto che le motivazioni fornite dal governo offrissero un sostegno limitato a questa giustificazione.

This was determined by Judge Timothy Kelly, who stated that Donald Trump must restore access to CNN, MSNBC, and Politico to the U.S. government headquarters after journalists from those outlets had their access revoked.
In his ruling, Kelly stated that the revocation of press passes for journalists occurred without a “fair constitutional process.” According to the judge, therefore, the action could be deemed unconstitutional.

The action comes in the context of the conflict between the Trump administration and some major U.S. news organizations. In recent months, the President of the United States has repeatedly attacked on social media various publications, among other things arguing that CNN, MSNBC, and Politico “should not be able to write or report constantly INVENTIONS and LIES.”
The administration had also justified the ban based on alleged national security reasons. However, according to CNN, Judge Kelly found that the government’s justification offered limited support for this explanation.
