Agi: Omicidio Custra non è prescritto, Ventura deve scontare la pena AGI - La Corte d'Assise d'Appello di Milano ha stabilito che Raffaele Ventura, ex componente delle Formazioni Comuniste Combattenti e che vive in Francia, dovrà scontare una pena residua di 14 anni di reclusione per l'omicidio del brigadiere Antonio Custra, avvenuto a Milano il 14 maggio 1977. I giudici hanno accolto la richiesta della procuratrice generale Francesca Nanni di revocare la prescrizione relativa a quel delitto, per il quale Ventura era stato condannato a 22 anni e 8 mesi di reclusione. La decisione sulla prescrizione della pena La pg ha portato avanti la tesi, e la Corte le ha dato ragione, che il trascorrere della prescrizione si bloccò nel 2017 quando Ventura venne sottoposto a un "arresto provvisorio" per sei ore da parte della polizia francese su mandato delle autorità italiane. Questo episodio ha bloccato la prescrizione della pena, che e' ripartita appunto dal 2017 ed è ancora attuale. Il ricorso annunciato dalla difesa "Fino alla Cassazione sarà libero di andare e venire dalla Francia - spiega il suo legale Davide Steccanella -. Andrò in Cassazione per farmi spiegare come sia possibile ritenere l'inizio dell'esecuzione della pena per l'omicidio Custra del 14 maggio 1977 una sosta di 3 ore in una stazione di polizia senza vedere un giudice, in forza, si legge, di un mandato di arresto europeo dove vengono indicate condanne per fatti commessi fino al 1976. Quindi un anno prima e senza alcun riferimento non solo a Custra ma neppure al reato di omicidio". La vicenda giudiziaria tra Italia e Francia La Suprema Corte aveva accolto il ricorso della procuratrice Nanni contro l'ordinanza che due anni fa aveva dato la possibilità a Ventura, che vive da decenni in Francia sulla base della cosiddetta "dottrina Mitterrand", di rientrare in Italia da libero, se volesse. Ventura era uno dei 10 ex terroristi che sarebbero dovuti tornare in Italia dalla Francia nel 2021, dopo un accordo politico tra i due Paesi, per scontare le pene, ma i giudici francesi bocciarono le richieste di estradizioni. Dalla Cassazione si era poi arrivati ai giudici della Corte d'Appello che oggi hanno revocato la prescrizione. E' improbabile comunque che, anche in caso della conferma in Cassazione della decisione dei giudici milanesi, la Francia dia l'ok all'estradizione del 76enne Ventura. Il Fatto Quotidiano: Tenta di violentare una ventenne, lei lo respinge e lui la tortura tenendole anche la testa sott’acqua: arrestato grazie all’allarme di un passante Un pomeriggio trascorso insieme a un uomo si è trasformato in un’aggressione di estrema violenza. Una ragazza di 20 anni è stata soccorsa lungo le sponde del fiume Pescia, nell’omonimo comune in provincia di Pistoia, dopo essere stata aggredita da un 38enne. La Polizia di Stato ha eseguito nei suoi confronti, cittadino della Repubblica Dominicana residente a Montecatini Terme e con precedenti specifici, un’ordinanza di custodia cautelare in carcere. L’uomo è accusato di tortura e tentata violenza sessuale. I due si erano dati appuntamento per trascorrere del tempo insieme. La situazione sarebbe degenerata quando l’uomo ha tentato un approccio di natura sessuale, respinto dalla giovane, cittadina italiana. Secondo la ricostruzione degli investigatori, dopo il rifiuto sarebbe iniziata l’aggressione. La 20enne sarebbe stata trascinata in acqua e sottoposta a una simulazione di annegamento. Una volta riportata a riva, l’uomo l’avrebbe colpita alle gambe con una cintura e con delle pietre e avrebbe spento alcune sigarette sul suo volto. A interrompere la violenza è stato un passante, che avrebbe sentito le urla della ragazza e lanciato immediatamente l’allarme al 112. Alla vista dei soccorsi, l’aggressore si sarebbe allontanato, facendo perdere le proprie tracce. Le indagini della Squadra di polizia giudiziaria del Commissariato di Pescia hanno consentito agli investigatori di identificare e rintracciare rapidamente il 38enne. Dopo gli accertamenti e su disposizione dell’autorità giudiziaria, l’uomo è stato trasferito nel carcere di Pistoia. La giovane è stata soccorsa e sottoposta alle cure mediche. Il Fatto Quotidiano: Fuoco amico durante un’esercitazione Nato in Lettonia: quattro militari italiani feriti. “Nessuno è in pericolo di vita” Quattro militari italiani sono rimasti feriti durante un’esercitazione a fuoco – cioè con l’impiego di munizioni reali – della Nato in Lettonia. L’incidente è avvenuto nel tardo pomeriggio nell’area di addestramento di Ādaži, dove un veicolo con a bordo quattro soldati dell’Esercito è stato colpito da una raffica esplosa da una mitragliatrice installata su un altro mezzo militare italiano. I quattro, di cui uno in condizioni più serie, sono stati immediatamente soccorsi e trasferiti in una struttura sanitaria di Riga, dove sono attualmente sottoposti alle cure e agli accertamenti necessari: nessuno di loro risulta, al momento, in pericolo di vita. Sono state immediatamente avviate le verifiche per accertare le cause e ricostruire la dinamica dell’accaduto. I quattro militari feriti appartengono all’11esimo Reggimento Bersaglieri, impegnato nell’ambito della missione Nato Forward land forces, che ha l’obiettivo di rafforzare la deterrenza e la difesa collettiva sul fianco orientale dell’Alleanza. I familiari dei soldati sono stati informati. Il ministro della Difesa, Guido Crosetto, è costantemente informato dal capo di Stato maggiore della Difesa, Luciano Portolano, e dal comandante del Covi, Giovanni Maria Iannucci, sulle condizioni dei connazionali e sugli sviluppi degli accertamenti in corso. Secondo quanto ricostruito, una raffica di mitragliatrice è partita accidentalmente da un veicolo corazzato Dardo manovrato da militari italiani e ha colpito un altro mezzo dello stesso tipo che lo precedeva con il portellone aperto, forse perché i militari stavano scendendo dal cingolato. Le indagini punteranno a ricostruire l’esatta dinamica di quanto accaduto e ad accertare eventuali errori umani. In particolare, sarà necessario chiarire come sia potuto avvenire l’incidente, dal momento che il veicolo Dardo da combattimento – cingolato in dotazione ai reparti della fanteria pesante dell’Esercito italiano dal 2002 – richiede la presenza e il controllo diretto di un equipaggio per svolgere le sue funzioni principali. Lo stesso vale per la mitragliatrice coassiale da 7,62 millimetri, dalla quale potrebbe essere stata esplosa accidentalmente la raffica di colpi. Il mezzo è inoltre dotato di un cannone automatico. In particular, it will be necessary to clarify how the incident could have occurred, as the Dardo combat vehicle – tracked and equipped to infantry heavy units of the Italian Army since 2002 – requires the presence and direct control of an crew to perform its main functions.
