One detail on the adopted amendments on protecting encrypted communication: They are specifically worded to also exclude client-side scanning, which is scanning of content before the encryption takes place for the transmission: "... interpersonal communications to which end-to-end encryption is, has been or will be applied". So the main fight is now on the limitations on the scanning in the long-term Regulation. The Parliament needs to stick to its very restrictve line to not allow general #chatcontrol, but only look into communications of specific suspects. So where are we? Parliament amended the Council position from first reading in its second reading (because the encryption amendments were adopted). Now, Council can accept it, and then this is it. If Council does not approve the amendments within three months, we go to Conciliation Committee and 3rd reading. Also, two amendments that would exclude the error-prone scanning for unknown material and for solicitation of children ("grooming") got a clear simple majority: 345+/237-/18a and 346+/254-/3a. Edit: To be clear, they were *not* adopted, since they failed to get an absolute majority of 360 votes. (4/X)

A core amendment from Greens, which limits the scanning to specific suspects, got a simple majority of 322 in favour, 255 against, 36 abstentions. Even though this was not sufficient for the required absolute majority, this sends a clear signal in view of the on-going negotiations on the long-term Regulation, where this is part of the Parliament's mandate. The Parliament wants to stick to this line, this became clear today. (3/X)

@HowTheyVoteEU The second plenary vote had already been scheduled, based on the assumption that a trilogue agreement on another extension of chatcontrol 1.0 would need to be approved. And even if there was no such agreement, taking items off an already agreed plenary agenda can only be done by unanimity of political groups, or a vote at the beginning of the session. Both was prevented by EPP.

Regulation (EU) 2021/1232 on "a temporary derogation from certain provisions of Directive 2002/58/EC as regards the use of technologies by providers of number-independent interpersonal communications services for the processing of personal and other data for the purpose of combating online child sexual abuse" https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A02021R1232-20240515, also known as #chatcontrol 1.0, just lapsed. It is illegal again to scan the content of private communications without initial suspicion.

In a major win for digital privacy, the European Parliament just (again) limited all scanning of communications for child abuse material to specific suspects. No mass surveillance, no #chatcontrol. Now the negotiations with Member States will be interesting. They are already supposed to start tomorrow morning.
