Il Tempo: Deceduto durante i controlli, la Procura iscrive gli agenti al nuovo 45 bis. "Fatti più estesi rispetto al video"
La Procura della Repubblica di Bologna, "all'esito dell'esame dei primi atti e della documentazione video acquisita anche attraverso gli apparati in uso alle forze di polizia", ha avviato un procedimento per chiarire "circostanze e cause del decesso" di Abderrahim Fakir, il 43enne morto ieri al Pilastro, a Bologna, durante un intervento della polizia nel corso del quale è stato bloccato a terra e ammanettato. Gli accertamenti riguarderanno "l'intero sviluppo dei fatti" e l'intervento "degli operatori sia delle forze dell'ordine sia del personale sanitario".
La Procura ha disposto "l'iscrizione nel procedimento, in apposito Registro Mod. 45 bis, nei confronti di quanti hanno preso parte alle diverse fasi del prolungato intervento". Si tratta dello strumento previsto per consentire gli accertamenti nei casi in cui debba essere valutata anche l'eventuale presenza di una causa di giustificazione, senza che ciò comporti un'esclusione automatica di responsabilità. Le verifiche, a partire dagli "accertamenti di natura medico-legale", serviranno a una "completa ed esaustiva ricostruzione dei fatti".
La documentazione video circolata finora, un filmato di circa 5 minuti, rappresenterebbe solo una parte della sequenza degli eventi oggetto dell'indagine che coprirebbero un intervento di 39 minuti. Gli inquirenti stanno acquisendo e analizzando ulteriori elementi per ricostruire tutte le fasi.
La procura di Bologna acquisirà le riprese delle telecamere delle bodycam dei poliziotti e il video registrato e diffuso dai familiari della vittima, ma anche altri filmati registrati da persone presenti sul posto.

Following the examination of the initial documents and the video footage obtained, including that held by police forces, the Public Prosecutor's Office in Bologna has initiated a procedure to “clarify the circumstances and causes of death” of Abderrahim Fakir, the 43-year-old who died yesterday at the Pilastro in Bologna during a police intervention in which he was brought to the ground and handcuffed. The investigation will cover “the entire development of events” and the actions of “both law enforcement officers and medical personnel.”
The Public Prosecutor’s Office has ordered “the registration in the procedure, in a specific Register Mod. 45 bis, of all those who participated in the various phases of the prolonged intervention.” This is the tool provided to allow investigations in cases where the potential presence of a justifying cause is also assessed, without automatically excluding liability. The checks, starting with "medical-legal examinations," will serve for “a complete and exhaustive reconstruction of events."
The video footage circulated so far—a five-minute film—would represent only part of the sequence of events under investigation, which would cover a 39-minute intervention. Investigators are collecting and analyzing further elements to reconstruct all phases.
The Bologna Public Prosecutor’s Office will obtain recordings from police officers' bodycams and the video recorded and distributed by the victim’s family, as well as other footage recorded by people present on the scene.
