First take: I think Justice Gorsuch reached the right outcome on the scope of § 1 of the FAA in Brock as the case was argued, but it might be the wrong outcome if we focus on Brock's status as a distributor/franchisee. For Justice Gorsuch, it's all about text; for me it's about the purpose of the § 1 exemption for workers engaged in interstate commerce.
