NEW: One year in, Trump's troop deployment in D.C. is ongoing, unending, pointless — and very bad. The "America 250" flags are a particularly empty emblem on the uniforms of troops deployed on the streets of the nation's capital. UPDATE 2: James Comey is also seeking the suppression of evidence obtained via two warrants in his case — one involving his Apple iCloud account and the other involving two Google accounts. In the same motion, Comey is also seeking a Franks hearing — to challenge the underlying affidavits seeking the warrants — because, Comey argued, the warrants were "issued on the basis of affidavits designed to mislead the issuing magistrates."

Justice Kavanaugh has the opinion for the court, holding that states "may" make sports eligibility based on "biological sex." https://www.supremecourt.gov/opinions/25pdf/24-43_2b35.pdf

NEW: John Roberts's 5-4 opinion saving the Fed should have saved all independent agencies. In his 6-3 opinion over the Federal Trade Commission, however, Roberts ended the independence of the FTC and other agencies, sowing "chaos" across the federal government. Here’s what I wrote in November about these cases, assessing that the outcome could change America. https://www.lawdork.com/p/scotus-trump-removal-power I’ll have much more on what Roberts did today after I get some time to read and write. This will be my focus at Law Dork today.

In the Cook case, the court's decision — denying a stay of the lower court's order — will keep Lisa Cook in her role as a governor of the Federal Reserve while litigation continues. Kavanaugh joined Roberts and the liberals to create this majority. Thomas, Alito, and Barrett each wrote dissents.

Sotomayor is reading from her Slaughter dissent. (She wrote the dissent for the three liberals in that case.)

BREAKING: The Supreme Court, 6-3, overrules Humphrey's Executor, giving the president broad firing powers over the leadership of federal agencies and limiting Congress's power to limit presidential firings. In a 5-4 decision, however, the court said the Federal Reserve is likely different.
