This actually feels like one of those legal tests we need. AI bots don't have agency, they only have the security tokens of the humans and corporations that run them. Therefore the actions they take have to fall back to one of those.
So any action taken by the bot is effectively an action taken by Open AI.
That's currently my opinion, but I think that needs to become legal truth sooner rather than later.
