Dario Motions Update April 13
The state had not filed a response to the defense brief for quashing the indictment - the assistant writing the response was so behind on his work that the judge admonished him for stalling a different case. The judge gave the prosecution 30 days to file a response and ruled to postpone the trial.

The state had refused to provide communication between the prosecution and the detective, claiming privileged information. The defense requested a privilege log explaining what communication was privileged, and the judge dismissed the request without hearing any arguments. The prosecution attempted to have Dario’s lawyers disqualified for representing both him and Janette Goering, and they tried to fabricate a conflict of interest by offering him immunity if he testified against Janette.
