For what its worth, I'm familiar with an example where this works under German rules, too: The "Deutsche Amateur Radio Club" #DARC is a non-profic, but owns a for-profit publishing house (for radio-related literature) and a for-profit hotel (near HQ, they sometimes host people for meetings and stuff, otherwise, its open to the public).

So the legal situation isn't hopeless. Still, if you ever want to go there, you absolutely need a lawyer or three.
