@ChrisMayLA6@zirk.us This rentcharge thing is something I've not come across before but, from the links I gave earlier, is not related to renting a property in the way we normally understand it. Also, it seems to be irrelevant as, according to the legislation, no new rentcharges can be created since 1977. A leasehold property is where you purchase the property for a specific number of years and pay ground rent, i.e. you acquire a chargeable interest in the property. This is not the same as...

@ChrisMayLA6@zirk.us That whole section is about "leases" but suddenly throws in the term "shorthold tenancies" without clarification. SDLTM00260 is very clear that the tax is chargeable on the acquisition of a chargeable interest. A person renting a property under a simple tenancy agreement does not acquire any sort of chargeable interest in that property.

@ChrisMayLA6@zirk.us I think you may have misunderstood the use of tenant in relation to the Stamp Duty Land Tax. As far as I can see by reading relevant parts of the manual, it refers to tenants with leases who acquire a chargeable interest in the property, not ordinary rental tenants who do not acquire such interest. https://www.gov.uk/hmrc-internal-manuals/stamp-duty-land-tax-manual/sdltm00260
