While I have you, here’s another hypothesis. I think such an arrangement might make it easier on us when, in the future, the law (hopefully) catches up to the technology. If I say you can have A, but your program takes A+B from the same website, that looks indistinguishable from you making a mistake of scope or permission. Oopsie, you say, that wasn’t malice, that was a bug. If the goods are quarantined on an entirely new server, on an explicitly de indexed site? You sought that out.

    Whatever fair use argument you might attempt at The Billboard Site, has no reason to apply to The Place Where I Keep My Valuables dot com. Especially if I have separately communicated to your organization that the entirety of the latter is off limits, and that we are to have no relationship. I’m under no illusion that this would be some magic gotcha, but rather it might chip away at the means for plausible deniability.
