QI doctrine essentially means that unless your rights were violated in EXACTLY the same way as someone else who won a case, the best you can hope is to spend outrageous amounts of money setting a precedent for the NEXT person who gets their rights violated in that exact way.

Since this is not a hugely attractive proposition, it often takes a while to find a sucker prepared to selflessly waste their money “clearly establishing” that a particular fact pattern is, in fact, a rights violation.
