@ilumium@eupolicy.social I don't think it matters much since Marketplace was undesignated by the Commission anyway because Meta stepped up enforcement against business users. That Art. 3(1)(b) requires the CPS to be an important gateway for business users to reach end users is a structural DMA issue since it means it's irrelevant, for the purposes of designation, whether it's an important gateway for end users to reach other end users.

@ilumium@eupolicy.social And that is then also reflected in the quantitative criteria in Art. 3(2)(b): 45M end users AND (not OR) 10K business users. That's also why iMessage and no virtual assistants or cloud services have been designated so far. It also hardly makes sense in the context of Article 7: interoperability between end users only is meant to solve the issue of a NI-ICS being an important gateway for business users to reach end users. Definitely something that needs fixing in DMA2.
