Yeah this, legally, No license means exactly that - They don't have a license to it, and no claim to it either. They can add a license all they want, it's not legal as you never released your claim to it. That's the primary purpose of a license, it releases your claims over the code such that others can use and contribute to it. Otherwise it's Source Available Closed Source Software.
