I think the US court is a little wrong here. If a songwriter from the US sells the copyright for a song to a UK entity, then once the sale is final, unless a clause was put in the contract to allow reclaiming it, the rights now belong to a UK entity and are governed by UK law, not US law. So, if that UK entity simply ignores "Termination" and keeps using it, the original songwriter would have to go to court in the UK.
