RE: https://curia.social-network.europa.eu/@Curia/116684940972542605 Oh my that was not on my bingo card today: The EU&#39;s General Court says Meta&#39;s #Marketplace isn&#39;t really a #gatekeeper under the #DMA because #Meta has made changes to its business user functionality which the EC didn&#39;t properly assess. The Court also confirmed that designating Messenger as a gatekeeper was correct. So kind of a half-win half-loss for the EC but I fear this will make the EC even more over-cautious and DMA enforcement even weaker. 😬 #DigitalMarketsAct

Okay maybe we have to wait for the judgement itself as the Court's press release kind of leaves it open if the Court has assessed the question whether #Meta #Marketplace is a CPS or if it stopped with finding the EC has not sufficiently assessed this. In which case the EC could try again. #DMA

@ilumium@eupolicy.social I don't think it matters much since Marketplace was undesignated by the Commission anyway because Meta stepped up enforcement against business users. That Art. 3(1)(b) requires the CPS to be an important gateway for business users to reach end users is a structural DMA issue since it means it's irrelevant, for the purposes of designation, whether it's an important gateway for end users to reach other end users.
