The maximum punishment outlined in the AI act is a fine of 7% of last year's turnover. OpenAI are promising investors a 17.5% return. OpenAI can literally budget for a maximum EU penalty and a significant return at the same time. A fine just becomes operational cost in an economic environment of rapid growth. It will do nothing to stop bad behavior. Bad actors will not hold back before they risk actual consequences.
