If the source code to OpenAI’s more-recent proprietary models were leaked, I have no doubt they’d ram the DMCA down the throat of anyone that hosted a copy. Regardless of your position on copyright it’s BS that OpenAI gets to break it but Pirate Bay doesn’t. (It’s another Wilhoit’s Law situation.)
