2002 haben drei unionsgeführte Bundesländer gegen das Lebenspartnerschaftsgesetz vor dem Bundesverfassungsgericht geklagt. Sie waren sich also damals noch sicher, dass das Grundgesetz die Diskriminierung gleichgeschlechtlicher Paare im Eherecht *vorschreiben* würde.
