LA NOTIZIA: L’intesa ancora non c’è, si tratta ancora sulle intercettazioni
È stallo sul decreto giustizia e immigrazione impantanato al Senato per alcuni nodi politici e per la mole di emendamenti, per cui le commissioni Affari costituzionali e Giustizia potrebbero non concludere l’esame, rinviando all’Aula le modifiche proposte dalla maggioranza, ovvero il testo base senza mandato al relatore. Inoltre, mancano alcuni pareri del ministero dell’Economia e del governo. Dopo una riunione di maggioranza durata circa un’ora al Senato, non si è trovata un’intesa: né sulle cosiddette ‘intercettazioni a strascico’, spinte da FdI con un emendamento su cui però FI resta contraria, né sullo stop ai risarcimenti danni per chi delinque.

Presente all’incontro anche il viceministro alla Giustizia, Francesco Paolo Sisto di FI. Sisto ha spiegato che la posizione sulle intercettazioni è stata ribadita dal segretario Antonio Tajani (“non capiamo perché si debba cambiare la legge che abbiamo cambiato noi”, ha detto). Sui risarcimenti, seppur condivisi dal centrodestra che lunedì aveva annunciato un emendamento ad hoc mai depositato, ci sono dubbi sull’ammissibilità e l’omogeneità.
Nella maggioranza c’è chi ammette che si tratta di una norma di natura civilistica, a differenza del resto del decreto che ha una portata ampia ma più penalistica. Si potrebbe perciò virare sull’ultimo disegno di legge sicurezza varato dal governo, che contiene già la norma: di certo, avrebbe un iter parlamentare più lungo ma meno rischi di ammissibilità.
Il nodo dei tempi
In ogni caso sul decreto giustizia e immigrazione pesano i tempi, visto che va convertito in legge entro l’11 agosto compreso il passaggio alla Camera. Al Senato il voto degli emendamenti procede a rilento (le commissioni sono ancora sull’articolo 1) e l’esame in aula è già slittato di una settimana per i tanti emendamenti sul tavolo – oltre 570 quelli presentati, per lo più delle opposizioni – ma è atteso la prossima. Pena, tempi troppo stretti per chiuderlo.

The decree on justice and immigration is stuck in the Senate due to political knots and the sheer volume of amendments, meaning that the Constitutional Affairs and Justice committees may not conclude its examination, postponing changes proposed by the majority – the basic text without a mandate to the rapporteur – to the plenary session. Furthermore, opinions from the Ministry of Economy and the government are still lacking. After a ruling coalition meeting lasting about an hour in the Senate, no agreement was reached: neither on so-called “dragnet interceptions,” pushed by FdI with an amendment that FI opposes, nor on stopping compensation payments for those who commit crimes.

Justice Undersecretary Francesco Paolo Sisto of FI was also present at the meeting. Sisto explained that the position on interceptions had been reaffirmed by Secretary Antonio Tajani (“we don’t understand why we have to change the law that we ourselves changed,” he said). Regarding compensation, despite support from the center-right which had announced an ad hoc amendment on Monday that was never deposited, there are doubts about admissibility and uniformity.
Within the majority, some admit that it is a civil law norm, unlike the rest of the decree which has a broad but more penal scope. It would therefore be possible to pivot to the latest security bill approved by the government, which already contains the provision: certainly, it would have a longer parliamentary process but less risk of admissibility.
The knot of time
In any case, the justice and immigration decree is weighed down by timelines, given that it must be converted into law by August 11th, including passage to the Chamber of Deputies. Voting on amendments in the Senate proceeds slowly (the committees are still on article 1) and examination in the plenary session has already been postponed by a week due to the many amendments on the table – over 570 were presented, mostly by the opposition – but it is expected next. Otherwise, the deadlines would be too tight to close it.
