Some dominant companies engaging in predatory behaviour do not meet the quantitative and qualitative thresholds of the law, which limits competition and contestability in the EU digital makers, hampering interoperability and software freedom, and forces business and end-users into vendor lock-ins. A review of the DMA should have expanded the regulation’s scope to a broader range of companies as well as to new types of Core Platform Services.

Gatekeepers have been abusing account requirements to avoid their obligations under the DMA. A review of the legislation should have explicitly prohibited gatekeepers from requiring paid or unpaid online accounts for requesting interoperability or to distribute apps outside of or through competing app stores.
