I am currently selling my house which is why I can relate info about this to you.
My home is paid off but in 2016, the RELEASE OF MORTGAGE was not filed for an 80k balance due. I have all paperwork and info proving that indeed this was paid so that is not in question. But I needed to have the original seller SIGN OFF on this lien release because essentially his name is on the title and the Title Co will not insure the Title until HIS NAME IS OFF.
This included having to track this dude down from ten years ago and explain what happened. Luckily, we found him, he responded and hopefully this will be taken care of today.
My point to you -------- I could NOT sell my home until this happened. Having this incomplete filing was enough to stop my home sale. If your name is on that deed, YOU OWN A PORTION OF THAT PROPERTY, whether that is a legit claim or not. The TITLE SAYS you own a portion.
So whether you go after the property by getting your dads name off or not, they cant sell that land without your cooperation.
Maybe your cooperation is worth some money................ just saying
