Because of the intelligence part, and there are a lot of places where animal abuse is illegal.

So should we take rights away from mentally handicapped people and children under certain age? The difference is that animals, including humans can and do feel. Both mentally and physically. Artificial intelligence does not and will not. We or it itself can make it imitate feeling things, but that’s only learned behaviour.
