There is a very much hardcoded list of instances that determine whether a piefed instance is considered to have a good “defederation policy” or not.

Edit: I was thinking of the default defederation list As far as I understand it, it’s not “hardcoded” in the sense that all piefed instances have it (otherwise I wouldn’t be able to respond to you). From what I understand, there is a default list, but this can be edited by any instance admins.
