ISOC has filed an amicus brief supporting Netflix's appeal of AGCOM Resolution 207. The statute defines an electronic communications network by one thing: transmission of signals. CDNs don't do that. They operate at the application layer and don't transmit to third parties. 3/5

    This isn't our idiosyncratic read. The IETF, ITU, and ETSI all describe CDNs as systems that optimize delivery over existing networks—not as networks themselves. Even AGCOM's own description of CDNs concedes the point. 4/5
