To submit a DMCA take-down notice, you must swear under penalty of perjury that the target contains copyright material that you own. Note that you do not have to swear that you have reason to believe that it is infringing behaviour or that it does not constitute fair use. The recipient of the notice must take down the hosted material. Failure to do so makes them liable for any infringement. The person who uploaded the material may submit a counter-notice. At this point the hosting entity may restore it but there are no legal penalties for them if they do not. This means that most companies ignore counter notices.
