So the situation (described here: https://techcrunch.com/2026/07/24/us-accuses-american-of-allegedly-wiping-his-phone-using-a-duress-password-during-border-search/) is a bunch of bullshit on a number of levels, but the part that makes me want to scream is the obvious incongruity of “we could take and search his phone because he wasn’t technically admitted to the United States yet” paired with “we’re charging him under US law for having done this thing” - did the just go ahead and admit him to the US after the seizing but before the proffering of the code? why the fuck would they do that? if they didn’t do that, he wasn’t in the US apparently, so how the fuck is he liable for following US law? These liminal spaces between being someplace and not being someplace are just straight up bullshit.
