"Just fork it" dismisses the ethical question. Seeing as Torvalds is the BDFL of the Linux kernel, it is his privilege to take that approach --- as he has done consistently for decades. He is by no means a Free Software proponent and falls firmly in the Open Source camp. But not everyone is satisfied with ignoring the ethical questions.
