As I recall, that Mastodon is a GmbH and not a gGmbH for reasons of the German government in late 2025, not due to wants or decisions made by any person in the organisation.
It's also, apparently a temporal situation until a legally binding non-profit situation can be restored.

@iju@mastodon.social Exactly—that means that, under German law, “Mastodon” does not, in fact, meet the criteria for a nonprofit organization. It’s only natural that every company would like to be a nonprofit, because that means they’re taxed differently. A nonprofit company could never have paid out 1,000,000 euros to its employees. @_elena@mastodon.social
