It is structural, and cultural (culture begets structures which replicate culture which produce more systems for it, etc). The modern nationstate, in kind, was born from heteronormative assumptions, and every state will act the same when inevitably put through the same instability that States inherently bring along with them, because "the state", as modernly conceived, is universally rooted in heteronormative assumptions. The state will ALWAYS be an enemy to queerfolk. It may forget about us until crisis, but rest assured we are always painted a target when the time comes.
