Too uncertain a case for them to try suing, especially with the possibility of a countersuit given you notified them of the fraud. Thus the credit card issuer has very limited options when you refuse to do the heavy lifting for them. In my case, it would be funny as hell seeing someone steal my identity, then wonder why credit card fraud earned them an "anti-terror" goon squad smashing down their door with long guns out and a no-knock warrant. Identity thieves take this random risk with every identity they steal-they could steal the identity of someone the cops consider a bigger fish than they are.
