Do you still get the presumption of innocence when a court judgement already exists that says you did the things you’ve been charged of
Also, does old mate own a Ford Bronco?

@MattHatton@aus.social simple answer? Yes. In reality, it’s really complicated. The prosecution still needs to prove each element of the offence “beyond a reasonable doubt“, and BRS will be entitled to a presumption of innocence as they do so. Findings made in other courts may be used in places but cannot* support – in the absence of other evidence – a specific finding in a criminal trial that something did or did not happen. And even then, it’s even more complicated than that! *for the sake of this post.
