However, these are policies that already apply to other areas, such as, e.g., computer hardware: in most places, you can't just go and get yourself a computer, at least not with public money. No subscriptions, no APCs, just tenders. With ORE the EU has already shown how public institutions should award contracts for their publishing needs.

The negative framing of calls for reform may be a problem - everyone can see you're against APCs and subscriptions, and pre-publication peer review, but you need to have a clearly-stated positive vision that takes institutions and researchers with you to a sustainable alternative. Gates have jumped the gun by not having that articulated.
