Regarding the kernel, it definitely seems to be more of #2. I don't know the details about why, but it is based on kernel 4.19.
If I understand correctly, the phone has all of the technology necessary for the AT&T network but AT&T does IMEI allowlisting so that you can only connect with their phones. I'm sure there are means of spoofing an IMEI number from an approved device but that would be illegal in most jurisdictions.

For AT&T, I bought an international version of a carrier unlocked phone and had to go to my AT&T account to register the IMEI, after that, it got accepted and started receiving service. So I think FLX1s should work with the same procedure.
