Challenge on basis of undefined defendant when an amalgam of FOSS code with countless contributors across countless jurisdictions LACKS a function. Demand judicial clarification on the premise. Seek contradictory mandates in sympathetic jurisdictions. Raise the challenge, dammit. Condescension implies false sense of a high ground. I’m saying we’ve spent decades on these issues; don’t undo that by sprinting to a concession.
