Street activist here.
Any cop can arrest you at any time just because they want to. The legality of the arrest only comes up later, if they decide to charge you.
Most arrests aren't followed up by a charge, meaning that there is no examination of the legality.
It's a shitty system but somehow no electoral party has decided it's worth changing; possibly because it's convenient to the government, and in order to change it a party has to be the government.

@passenger @bms48 @Geri Do you know if arrests without charges appear on things like a DBS, or Disclosure Scotland? That’s something I’ve always found a bit scary because my line of work often requires those to be clean.
